Landlord needs to sell

Amy contacted the Landlord Advice helpline as financial problems meant she was going to have to sell the property she rented out.  She had told her tenants who had started to look for a new home but she wanted to make sure she was following the right process

We took Amy through her options one of which was selling with the sitting tenants.  Amy was concerned that this would mean the property would take longer to sell and made the point that her tenants were happy to leave.

With that being the case we advised Amy that as the tenants had been in the property for 7 years she needed to give them 8 weeks written notice to quit. We outlined that even after the notice period that Amy could not force the tenants to leave or change the locks.  We explained that if the tenants were still there after the notice period Amy would need to follow due process and seek a Court Order.
